1. Who We Are
Portugalia dla Polaków ("we", "our", "us") is a platform operated by a Portuguese-Polish team that connects Polish travelers with local service providers in Portugal.
We act as an intermediary — we help you discover authentic Portuguese experiences and connect you with trusted local providers. We do not operate as a tour operator.
2. Our Intermediary Role
IMPORTANT: We are NOT a tour operator. We do NOT fall under the EU Package Travel Directive. We connect Polish travelers with Portuguese service providers (surf schools, wine tour operators, accommodation providers, real estate agents, etc.).
We connect you with providers — we do not offer the services ourselves. The actual services (surf lessons, wine tours, accommodation, property transactions) are delivered by independent Portuguese providers. Each provider is responsible for the quality and delivery of their services.
3. Contact and Booking Process
Here's how the process works:
- You contact us via WhatsApp, Telegram, or email to inquire about a specific experience or service in Portugal.
- We connect you with the appropriate Portuguese provider and facilitate communication (translation, clarifications, recommendations).
- You book directly with the provider. The contract is between you and the provider — not with us.
4. Liability Limitations
As an intermediary platform, we connect travelers with providers but are not liable for the services delivered by those providers. Providers are responsible for service quality, safety, cancellations, refunds, and any issues arising from the service.
We carefully vet providers and only recommend those we trust. However, we cannot guarantee the performance of third-party providers. This limitation does not exclude mandatory consumer protections under Polish and EU law.
5. Intellectual Property
All content on this website (text, images, logos, design) is protected by copyright and owned by Portugalia dla Polaków or licensed for use. Unauthorized reproduction, distribution, or use is prohibited.
6. Governing Law
For consumer contracts, Polish consumer protection laws apply as per the Rome I Regulation (EU Regulation 593/2008). You retain all mandatory consumer rights under Polish law.
Disputes related to services provided by Portuguese providers are governed by Portuguese law and EU consumer protection regulations.
7. Dispute Resolution
If you have a complaint or dispute, please contact us first at info@portugaliadlapolakow.pl. We are committed to resolving issues amicably through negotiation.
For consumer disputes, Polish courts have jurisdiction. You may also use the European ODR platform for online dispute resolution: https://ec.europa.eu/consumers/odr
8. Terms Updates
We may update these Terms & Conditions from time to time. Changes will be announced on the homepage. Continued use of the platform after changes constitutes acceptance of the updated terms.

10. Cancellation and Termination Policy
When you cancel a confirmed travel package, the graduated cancellation fee schedule applies per the EU Package Travel Directive (Directive 2015/2302, Articles 12, 15, 16) and Portuguese Decree-Law 17/2018. See our Cancellation Policy page for the complete fee table.
The 14-day distance-contract right of withdrawal does not apply to package travel under Polish Consumer Rights Act Article 38. This is the established carve-out for travel bookings confirmed with specific travel dates.
Cancellations must be requested in writing via email to info@portugaliadlapolakow.pl with your booking reference. Refunds are processed via Stripe within 5–10 business days. For cancellations within 48 hours of the trip start, you may be eligible for an additional EUR 50 inconvenience credit. (Directive 2015/2302 Arts. 12, 15, 16; PT Decree-Law 17/2018; Polish Consumer Rights Act Art. 38)
11. Automated Booking Process
After payment, our AI booking assistant contacts your selected suppliers to make reservations in your name. The assistant uses Claude (an AI model by Anthropic) and acts under our supervision. This is an automated decision-making (ADM) process under GDPR Article 22.
You have the right to opt out of automated processing at checkout and request that our team handles your booking personally. This right is exercisable via the checkbox on the payment review page and via written request to info@portugaliadlapolakow.pl. If anything cannot be confirmed automatically, our team will contact you within 2 hours. (EU AI Act Art. 50; GDPR Art. 22)
12. Identity Document Policy
We never collect passport, ID, or other government-issued document numbers in our booking configurator. If a supplier requires identity verification (e.g., accommodation check-in), we will contact you AFTER booking confirmation with a one-time secure upload link.
Identity documents shared with us are stored for a maximum of 30 days after the trip's completion, then permanently deleted. Where you provide an identity document directly to a supplier, that supplier acts as an independent data controller. We do not retain copies of supplier-direct identity disclosures.
